The Colorado District Court has ruled in favor of the Colorado State Parks agreement allowing Christo to use portions of the Arkansas Headwaters Recreation Area for Over The River.
“I am very happy with the Colorado court’s decision to uphold the State Parks agreement,” said Christo. “We have now cleared two of the three legal hurdles that need to be overcome and I look forward to the federal court making its decision on the third case still pending.”
In its decision to deny and dismiss the complaint filed by an opposition group, the state court focused on hundreds of extensive mitigation measures identified to protect the environment and local communities, as well as the significant benefits to State Parks from Christo and Jeanne-Claude’s two week temporary work of art.
The court noted the importance and effectiveness of the Over The River mitigation measures by calling them “a topic of continual discussion prior to approval of the Agreement in 2011.”
The only legal challenge to Over The River yet to be ruled on is in federal court and updates will be provided as new information becomes available. Christo and the OTR team greatly appreciate your continued support and enthusiasm for Over The River.
